Acceptance and scope
These Terms of Use (“Terms”) are an agreement between you and Wasatch Parking LLC, doing business as Wasatch Parking (“Wasatch Parking,” “we,” “us,” or “our”). By accessing or using www.wasatchparking.com or a related public service-status page, you agree to these Terms. If you do not agree, do not use those public website services.
These Terms cover the public marketing website and status page only. Transactions, violations, permits, appeals, accounts, or other activity through the secure driver portal may be governed by separate terms, policies, parking rules, signage, notices, and client agreements.
Information only; no service agreement
Marketing pages, articles, service descriptions, examples, and status information are provided for general informational purposes. They are not a quote, guarantee, legal opinion, parking authorization, violation decision, appeal decision, or promise that a particular service or result is available.
Sending an email or website inquiry does not create a parking-services agreement, agency relationship, confidential advisory relationship, or obligation to accept a project. Parking services begin only under mutually accepted terms or another applicable authorization.
Acceptable use
You may use the public website for lawful, personal, or legitimate business purposes. You may not:
- Interfere with, overload, damage, probe, or circumvent the website or its security controls.
- Use automated means to scrape or access the site in a manner that disrupts service or violates law.
- Submit false, deceptive, unlawful, infringing, threatening, or malicious content.
- Impersonate another person or misrepresent your authority or affiliation.
- Introduce malware or attempt unauthorized access to accounts, systems, data, or provider services.
- Use website content or branding in a way that falsely suggests sponsorship or endorsement.
We may restrict access or take other appropriate action when we reasonably believe the website is being misused.
Inquiries and submissions
If you send an inquiry, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it. Do not submit payment-card data, violation or appeal evidence, license plates, access codes, government identification, credentials, or other sensitive information through the marketing-site inquiry form or ordinary email.
We may use inquiry information to deliver, secure, review, and respond to the request and to prevent abuse, as explained in our Privacy Policy. An inquiry is not accepted until the website reports successful delivery or our team receives it through another confirmed channel.
Intellectual property
The website and its original text, design, graphics, logos, photographs, software, and other content are owned by Wasatch Parking or used with permission and are protected by applicable intellectual-property laws. You may view and print reasonable portions for your own lawful, noncommercial evaluation of our services.
Except as permitted by law or with written authorization, you may not reproduce, publish, distribute, modify, create derivative works from, sell, license, or exploit protected website content. No license to Wasatch Parking names, marks, or logos is granted by these Terms.
Third-party services and links
The website may link to the secure parking portal, social platforms, or other third-party services. Links are provided for convenience and do not mean that we control or endorse every third-party statement, product, security practice, or policy. Your use of a third-party service is governed by its own terms and notices.
Website availability and status information
We work to keep the public website useful and available, but we do not promise uninterrupted, error-free, or continuously current access. We may change, suspend, restrict, or discontinue all or part of the website when reasonably necessary.
A public status page is an informational summary based on the latest approved checks and updates. Reports may be delayed, incomplete, or later corrected. Status information does not replace a transaction receipt, parking authorization, posted rule, direct customer communication, contract notice, or emergency instruction.
Disclaimers
To the fullest extent permitted by law, the public website and its content are provided “as is” and “as available.” Wasatch Parking disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement as they relate to the public website.
We do not warrant that website content is complete, current, or suitable for every property, event, driver, jurisdiction, or operational need. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
Limits on liability
To the fullest extent permitted by law, Wasatch Parking and its affiliates, officers, employees, agents, and website providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising from use of or inability to use the public website.
To the fullest extent permitted by law, aggregate liability for direct damages arising solely from the public marketing website will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid specifically to use that public website during the twelve months before the event giving rise to the claim. This section does not limit liability that cannot lawfully be limited.
Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, except where applicable law requires otherwise. Any dispute concerning these Terms or the public website may be brought in a court with jurisdiction in Utah, subject to any rights or venue protections that cannot be waived.
If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of it.
Changes and contact
We may revise these Terms as the public website or our practices change. Revised Terms will be posted here with an updated date. Continued use after revised Terms take effect means you accept them to the extent permitted by law.
